A Federal High Court in Abuja has ordered the immediate sack of a senator, Atai Aidoko as the member representing Kogi East in Senate.

Justice Gabriel Kolawole in his judgment on Wednesday held that the primary election of the Peoples Democratic Party (PDP) on November 7, 2014 , which eventually announced Aidoko as winner lacked integrity and credibility.

Justice Kolawole declared Air Vice Marshal Isaac Alfa (rtd) as the winner of the primary election.

The judge ordered the Clerk of the Senate to make arrangement for the immediate swearing in of Alfa and all the benefits and entitlements paid to him.

The judge noted that evidence corroborated by officials showed that Alfa was leading the primary with 129 votes, while Aidoko was on 80 votes before the voting was disrupted by Police and thugs, and he polled 101 votes upon reconvening.

Aidoko was declared winner of the rerun of the election after the winner of the March, 2015 election, Abdulrahman Abubakar of the All Progressives Congress (APC) was disqualified by the Election Tribunal.

After Aidoko’s declaration as the party’s flag bearer, Alfa, began a legal battle for the nullification of his election.

An appeal court had ordered parties to return to the trial court to allow it determine the rightful owner of the suit, thus rendering the seat vacant.

However, Aidoko refused vacating the office and has appeared repeatedly at Senate plenaries since then.
